BY ACCESSING, USING, INSTALLING, OR DOWNLOADING THE BLUR VPN APPLICATION, SOFTWARE, WEBSITE, OR ANY RELATED SERVICES (COLLECTIVELY, THE “SERVICE”), YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF USE (“TERMS”). THESE TERMS CONSTITUTE A LEGALLY BINDING ELECTRONIC AGREEMENT BETWEEN YOU AND SENOCOM LTD. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS, INSTALL, DOWNLOAD, OR USE THE SERVICE.
If you are a consumer residing in the European Union, including Cyprus, nothing in these Terms limits your mandatory statutory rights under applicable law, including consumer protection legislation and rights that cannot be excluded or limited by contract.
1. Definitions
“Senocom Ltd” means Senocom Ltd, a company incorporated under the laws of the Republic of Cyprus, with registered office at Cyprus, Limassol, Kapsalion 4, 4044, Cyprus, and registration number HE468429. .
“BLUR VPN” or “Service” means the BLUR VPN application, website, software, systems, network, and any related services provided by Senocom Ltd, including VPN servers, protocols, and customer support.
“User”, “you”, or “your” means any natural person or legal entity that accesses or uses the Service.
“Premium” means the paid subscription tier, if offered, which may provide additional functionality such as faster servers, more locations, or reduced advertising.
“Free Version” means any non-paid or advertising-supported tier, if offered, which may include limitations such as fewer server locations, reduced speeds, or advertising.
“Content” includes software, code, text, graphics, trademarks, logos, interfaces, and all materials provided by or through the Service.
2. Eligibility and Capacity
You may use the Service only if you are at least 18 years old, or the age of legal majority in your country of residence, and you have legal capacity to enter into a binding contract. By using the Service, you represent and warrant that you meet these requirements.
If you use the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms, and “you” includes that entity.
3. Scope of the Service
The Service provides VPN connectivity and related functionality intended to enhance privacy and security by encrypting traffic between your device and the VPN server.
Features may vary depending on your device, platform, subscription plan, and location. Certain features may not be available in all countries or on all operating systems.
You acknowledge that the Service depends on factors outside our control, including your device configuration, ISP, network conditions, third-party routing, congestion, and internet infrastructure. We do not guarantee uninterrupted availability, that any specific server will always be accessible, or that any particular speed, latency, or performance level will be achieved.
A VPN enhances privacy but does not guarantee complete anonymity or prevent all forms of tracking. For example, websites may still identify you through cookies, browser fingerprinting, account logins, device identifiers, or tracking technologies that operate outside the VPN tunnel.
Certain technical data may be processed transiently to operate, secure, and maintain the Service, as described in the Privacy Policy.
4. Licence and Permitted Use
Subject to your compliance with these Terms, Senocom Ltd grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Service for lawful purposes.
You may not copy, modify, distribute, sublicense, sell, rent, lease, reverse engineer, decompile, disassemble, or attempt to derive source code from the Service, except where mandatory law prohibits such restriction.
You may not bypass or defeat security measures, interfere with authentication systems, or attempt to access servers, accounts, or systems not intended for you.
All rights not expressly granted are reserved by Senocom Ltd and its licensors.
5. Acceptable Use and Prohibited Conduct
You agree to use the Service only in compliance with applicable laws and regulations, including laws relating to privacy, communications, data protection, and intellectual property.
You must not engage in unlawful activity, including fraud, hacking, harassment, unlawful surveillance, identity theft, or threats. You must not transmit malware, ransomware, spyware, or harmful code. You must not interfere with or disrupt the Service or networks, including by conducting denial-of-service attacks. You must not access systems or data without authorization. You must not distribute illegal content, including child sexual abuse material. You must not infringe intellectual property rights. You must not send unlawful spam. You must not circumvent payment systems, geographical restrictions, sanctions, or lawful enforcement.
You must comply with all applicable export control and sanctions laws and may not use the Service in violation of applicable embargoes or restrictions.
You remain solely responsible for your actions. A VPN does not make illegal activities legal.
6. Accounts, Premium, Payments, and Renewals
Certain features may require account creation and/or a Premium subscription. Where accounts are used, you agree to provide accurate information and keep it updated where necessary.
You are responsible for maintaining the confidentiality of your credentials and all activity under your account, including any use by third parties who gain access to your device.
Premium pricing, billing frequency, renewal terms, and plan features are displayed at purchase. Subscriptions may renew automatically unless canceled before renewal.
If purchased via Apple App Store, Google Play, or another platform, billing, cancellation, renewal, and refunds are governed by that platform’s terms in addition to these Terms.
If your access is terminated for breach of these Terms, this does not automatically entitle you to a refund except where required by applicable law or platform rules.
EU consumers may be asked to consent to immediate performance and acknowledge possible waiver of withdrawal rights where permitted by law.
7. Privacy and Data Protection
Senocom Ltd processes personal data and other information in accordance with our Privacy Policy, which forms part of these Terms. In case of conflict regarding data processing, the Privacy Policy prevails. Senocom Ltd does not sell personal data.
The Service is designed to minimize the processing of personal data and does not operate as a monitoring or tracking service. However, limited technical processing may be necessary to provide, secure, and improve the Service.
8. Third-Party Services and Advertising
The Free Version may include advertising or third-party components. Advertising or analytics technologies may involve third-party SDKs subject to applicable law and user consent as described in the Privacy Policy.
We do not control and are not responsible for third-party services, websites, SDKs, content, offers, or policies. Your dealings with third parties are solely between you and that third party.
Premium versions may not display ads within the app; however, this does not affect any tracking, cookies, or policies of third-party websites or services you access while using the VPN.
9. Service Changes and Updates
We may update, modify, suspend, or discontinue any aspect of the Service for security, legal, operational, or performance reasons. This may include changes to features, server locations, protocols, pricing, availability, or supported devices.
We may install updates automatically where necessary, including updates required for security or compatibility. You agree that some updates may be required for continued use of the Service.
If you are an EU consumer and a material change negatively affects Premium access, we will provide notice and any remedies required by law.
10. Suspension and Termination
You may stop using the Service at any time. If you have a subscription, you must cancel it through the platform or method provided to avoid renewal charges.
We may suspend or terminate access if we reasonably believe you have violated these Terms, used the Service unlawfully, attempted to abuse the Service, created risk to the Service or others, or where required by law.
Upon termination, your licence ends immediately. Provisions intended to survive termination (including payment obligations, disclaimers, limitation of liability, indemnity, and governing law) survive.
11. Intellectual Property
The Service and all Content are owned by or licensed to Senocom Ltd and protected by intellectual property laws. You may not use our trademarks, logos, or brand elements without our prior written consent.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted, secure, error-free, or virus-free operation.
You acknowledge that no technology can guarantee absolute anonymity, security, or prevention of tracking.
Nothing in these Terms excludes mandatory consumer rights under applicable law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Senocom Ltd shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or loss of profits, revenue, data, goodwill, business opportunities, anticipated savings, reputational damage, or business interruption.
Where liability cannot be excluded, Senocom Ltd’s total aggregate liability in any 12-month period shall not exceed, for Premium users, the total amount paid in the 12 months preceding the claim. For Free Version users, Senocom Ltd’s liability is limited to the maximum extent permitted by applicable law.
Nothing limits liability that cannot legally be excluded, including death, personal injury caused by negligence, fraud, or wilful misconduct where prohibited by law.
14. Indemnity
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Senocom Ltd, its directors, officers, employees, contractors, affiliates, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Service, your breach of these Terms, your violation of any law or regulation, or your infringement of any third-party rights.
15. Force Majeure
Senocom Ltd shall not be liable for any failure or delay caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government actions, sanctions, cyberattacks, internet outages, power failures, failures of third-party networks, data centers, or service providers.
16. Assignment
Senocom Ltd may assign or transfer these Terms, in whole or in part, to an affiliate or successor in connection with a merger, acquisition, corporate restructuring, or sale of assets. Such transfer will not reduce your mandatory rights as an EU consumer. Where required by law, we will notify you.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where mandatory law provides otherwise.
17. Complaints, ADR, and ODR (EU)
If you have a complaint, you may contact us at [email protected] and we will attempt to resolve it. If you are an EU consumer, you may also be entitled to use alternative dispute resolution mechanisms in your country. The European Commission provides an Online Dispute Resolution (ODR) platform that may be used for eligible disputes.
18. Governing Law and Jurisdiction
If you are a consumer habitually resident in Cyprus, these Terms are governed by the laws of the Republic of Cyprus, and the courts of Cyprus shall have jurisdiction, without prejudice to any mandatory rights you may have to bring proceedings in your country of habitual residence within the EU. If you are a consumer habitually resident in another EU Member State, these Terms are governed by the laws of Cyprus, but you also benefit from the mandatory consumer protection laws of your country of residence, and you may bring proceedings in the courts of your country of residence.
If you are not a consumer, these Terms shall be governed by the laws of the Republic of Cyprus and the courts of Nicosia, Cyprus shall have exclusive jurisdiction, to the extent permitted by law.
19. Severability and No Waiver
If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver.
20. Changes to These Terms
We may update these Terms from time to time. Updates become effective when posted with an updated date. Where required by law, we will provide additional notice of material changes. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
